2. OVERVIEW
We only process personal data as far as necessary to run this website, answer your enquiries and handle pre-orders. We do not use analytics or advertising tools and do not use tracking cookies.
3. HOSTING AND SERVER LOG FILES
This website is hosted by Netlify, Inc., 101 2nd Street, San Francisco, CA 94105, USA. When you visit the site, technical data is recorded automatically: IP address, date and time, page requested, browser and operating system, and the referring page. This is necessary to deliver the website securely and reliably (Art. 6(1)(f) GDPR). Netlify keeps these log files only for a limited period. A data processing agreement with Netlify is in place (Art. 28 GDPR). Netlify may also process data in the USA. Netlify is certified under the EU-U.S. Data Privacy Framework, which the European Commission recognises as providing an adequate level of protection (Art. 45 GDPR). The EU standard contractual clauses also apply (Art. 46 GDPR). More: www.netlify.com/privacy
4. CONTACT FORM, EMAIL AND PHONE
If you send us a question via the contact form, by email or by phone, we process your name, email address or phone number and the content of your message in order to reply. The forms on this website are processed by our host's Netlify Forms service: your entries are stored at Netlify and forwarded to us by email. The legal basis is Art. 6(1)(b) GDPR where your enquiry relates to a possible purchase, otherwise our legitimate interest in answering (Art. 6(1)(f) GDPR) or your consent (Art. 6(1)(a) GDPR). We delete the data on our side and at Netlify once your enquiry has been fully dealt with, unless statutory retention obligations apply.
5. PRE-ORDERS
For a pre-order we process your name, email address, mobile number and chosen configuration (position, magnet, bobbins or cover, potting, wiring). We use this data to contact you before winding and to handle the order (Art. 6(1)(b) GDPR). The pre-order is non-binding. If you withdraw it or no purchase takes place, we delete your data. If a purchase takes place, we keep invoice data for as long as commercial and tax law requires (usually 6 to 10 years, § 147 AO, § 257 HGB).
6. APPLYING AS A STEELER ARTIST
If you apply as a Steeler Artist, we process your name, email address, the link to your channel, details of your guitar and style of music, and your message. We use them only for the selection and to contact you (Art. 6(1)(b) GDPR). For this we look at your public channel. If you are not selected, we delete your application no later than three months after the end of the selection round. If you are selected, we keep the data for the duration of the collaboration.
7. LANGUAGE SETTING
If you switch the language (DE/EN), the website stores this choice in your browser's local storage (localStorage). The information stays on your device and is not sent to us. You can delete it at any time in your browser settings. The legal basis is § 25(2) no. 2 TDDDG, as storage is strictly necessary for the function you requested.
8. FONTS
The fonts used are loaded locally from our own server. No connection to third-party servers (e.g. Google) is made.
9. INSTAGRAM
Our website links to our Instagram profile. This is a simple link; no Instagram content is embedded. Only when you click the link are you taken to Instagram (Meta Platforms Ireland Ltd.), where their privacy policy applies.
10. RECIPIENTS
We do not pass your data on to third parties, except to our host Netlify (see section 3), which delivers the website and processes the forms, to our email provider, and where we are legally required to. For transfers to the USA by Netlify, see section 3.
11. YOUR RIGHTS
You have the right of access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and to object to processing based on legitimate interests (Art. 21). You can withdraw consent at any time with effect for the future (Art. 7(3) GDPR). An informal message to luca@lucasguitars.de is enough.
12. RIGHT TO LODGE A COMPLAINT
You can lodge a complaint with a data protection supervisory authority. The authority responsible for us is:
Der Landesbeauftragte für den Datenschutz und die Informationsfreiheit Baden-Württemberg
Lautenschlagerstraße 20, 70173 Stuttgart, Germany
www.baden-wuerttemberg.datenschutz.de
13. OBLIGATION TO PROVIDE DATA
Providing your data is voluntary. Without contact details, however, we cannot reply to you or accept a pre-order. No automated decision-making or profiling takes place.
